Am 1. August 2017 ist die novellierte Gewerbeabfallverordnung 2017 (GewAbfV) in Kraft getreten. Diese Verordnung löst die Gewerbeabfallverordnung aus dem Jahr 2002 ab und soll insbesondere die Entsorgung gewerblicher Siedlungsabfälle und bestimmter Bau- und Abbruchabfälle an der 5-stufigen Abfallhierarchie des Kreislaufwirtschaftsgesetzes aus dem Jahr 2012 ausrichten. Im Vordergrund der Novelle stehen daher eine stärkere Akzentuierung der Trennpflichten (§ 3 Abs. 1 GewAbfV) und die Begründung eines Vorbehandlungsgebots für gewerbliche Abfallgemische (§ 4 Abs. 1 GewAbfV). Ab 2019 muss zudem bei der Vorbehandlung gewerblicher Siedlungsabfälle eine Recyclingquote von mindestens 30 Masseprozent erreicht werden (§§ 6 Abs. 5 S. 1, 15 Abs. 2 GewAbfV).
Doch kaum war die neue Gewerbeabfallverordnung im Bundesgesetzblatt erschienen, begann schon die Suche nach Schlupflöchern, um ihren strengen Trenn- und Recyclingvorgaben auszuweichen. Offensichtlich hat man sich in der Branche zu sehr daran gewöhnt, gewerbliche Siedlungsabfälle als Gemisch einer energetischen Verwertung zuzuführen, während das hochwertige Recycling ein Nischendasein fristet. Es wird daher entscheidend darauf ankommen, dass sich der behördliche Vollzug der neuen Gewerbeabfallverordnung intensiv widmet. Besonders gefordert ist die entsprechende Arbeitsgruppe der LAGA, die das LAGA-Merkblatt 34 bis Ende 2018 überarbeiten will. Es ist zu hoffen, dass das LAGA-Merkblatt 34 deutlich Position für die Trennung und das hochwertige Recycling gewerblicher Siedlungsabfälle bezieht und Umgehungsversuchen einen klaren Riegel vorschiebt. Wichtige Streitpunkte bei der Interpretation der GewAbfV 2017, die sich bereits jetzt abzeichnen, werden nachfolgend skizziert.
The amended Ordinance on Commercial Waste 2017 came into force on 1 August 2017. This Ordinance replaces the preceding Ordinance on Commercial Waste dating from the year 2002, it is intended to align the management of commercial municipal waste and certain construction and demolition waste streams with the 5-step waste hierarchy laid down in the German Circular Economy Act dating from 2012. First and foremost, the amended ordinance clearly emphasizes the obligations concerning separate collection (§ 3 para. 1 of the ordinance) and establishes a pretreatment obligation as regards mixed commercial waste (§ 4 para. 1 of the ordinance). In addition, a recycling rate of at least 30 mass percent has to be attained when pretreating commercial municipal waste as from 2019 (§ 6 para. 5 1st sentence, § 15 para. 2 of the ordinance).
Soon after the amended Ordinance on Commercial Waste had been published in the Federal Law Gazette, the search began for ways to avoid the strict separate collection and recycling obligations. Evidently, the concerned commercial sector has become used to managing commercial municipal waste as a mixed waste subject to energy recovery, i. e. waste incineration, whereas very little importance has been attached to high-level recycling. The success of the amended Ordinance will much depend on its consistent enforcement by the competent authorities. What is decisive are the results of the working group established by LAGA (committee set up by enforcement authorities of the German Länder and the federal level regarding waste law), who are revising the LAGA guidelines 34 until the end of 2018. Hopefully, the revised LAGA guidelines 34 will lay much value on the separate collection and high-level recycling obligations of commercial municipal waste and will incapacitate attempts to dodge these obligations. Important controversial moot points that are already looming with regard to the interpretation of the Ordinance on Commercial Waste 2017 are outlined below.
