Die meisten Unternehmen des Recyclingsektors können von der Ausnahme gemäß REACh Art. 2 Abs. 7d Gebrauch machen können. Dies setzt lediglich voraus, dass die Unternehmen eine Vorregistrierung vorgenommen haben, dass keine chemische Veränderung im Recyclingprozess auftritt und notwendige Stoffsicherheitsinformationen (z. B. Sicherheitsdatenblatt oder allgemeine Informationen) vorhanden sind. Insofern ist der Aufwand für die Recyclingwirtschaft höher als früher, jedoch kann ein deutlicher Imagegewinn für das aufbereitete Recyclingmaterial die Folge sein, weil das Material breiter absetzbar und anwendbar ist. Eine generelle Informationspflicht gilt jedoch wegen der Transparenz von Stoffströmen und Offenlegung von Stoffdaten, um gefährliche Inhaltsstoffe identifizieren zu können. Diese Informationspflicht gilt bereits seit Inkraftsetzung von REACh. Diese generelle Informationspflicht gilt auch für die Unternehmen, die mit ihren Stoffen und Gemischen im Abfallbereich bleiben. Denn mit der weiteren Einführung von GHS (Globally Harmonized System für Einstufung und Kennzeichnung von Stoffen und Gemischen) und CLP für Gemische bis 2015 und der letzten Registrierungsfrist gemäß REACH in 2018 wird es weltweit von Bedeutung sein, gefährliche Inhaltsstoffe von der Herstellung über die Weiterverarbeitung bis hin zur Entsorgung transparent zu machen und zu identifizieren.
Most of the recycling company can rely on the exemption of REACh (Art. 2 7d), but only these companies can use the exemption, if they made a preregistration of the substances. Another prerequisite is, that the substances which result from a recycling process, are the same as the substances which are registrated and that for those materials the company has all the substance informations (e.g. safety data sheets or general substance informations). The reason for more detailed substance informations is that there is a need because of REACh: More transparency of supply chains and more informations of substances with very high concern. This obligation is necessary since the REACh ordinance got into effect. These obligations with a lot more demands cover also companies which do not reach the end of waste status of their treated substances and mixtures. There is another legal background for more substance informations: Since GHS (Globally Harmonized System – classification and labelling of substances and mixtures) is implemented companies are obliged to consider new classification and labelling rules, for substances the deadline was end of 2011, for mixture the deadline will be 2015. Until 2018 – when the last REACh registration period will end, substances of high concern should be identified and classified. This is a need in the whole supply chain and perhaps worldwide, because some other countries beside EU have already similar obligations implemented.
